Terms of Service

Welcome to The Content Engine. By accessing or using our website at aicoursefinaly.vercel.appand related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Account Registration

To use the Service, you must create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must be at least 18 years old to use the Service.

2. Description of Service

The Content Engine is an AI-powered content marketing platform that helps you create, schedule, and publish content across social media platforms. The Service includes:

• AI-assisted content generation using large language models
• Social media account management (connecting, posting, and analytics for Twitter/X, Facebook, Instagram, TikTok, and LinkedIn)
• Brand analysis and content strategy tools
• Automated content workflows (on eligible plans)
• Competitor research and analytics
• White-label and multi-brand management (on Agency plans)

3. Subscription Plans and Billing

The Service is offered through paid subscription plans. By subscribing, you agree to the following:

• Billing: Subscriptions are billed monthly or annually, depending on your selection. All fees are in US dollars and are non-refundable except as required by law.
• Plan changes: You may upgrade or downgrade your plan at any time. Upgrades take effect immediately. Downgrades take effect at the end of your current billing period.
• Cancellation: You may cancel your subscription at any time. Your access continues until the end of the current billing period.
• BYOK plans: On Starter (Bring Your Own Key) plans, you provide your own LLM API key. You are responsible for any charges from your LLM provider. We do not control or guarantee third-party API pricing.
• Payment processing: Payments are processed by Stripe. By subscribing, you also agree to Stripe's Terms of Service.

4. Social Media Account Connections

When you connect social media accounts to the Service:

• You authorize us to access and interact with those accounts on your behalf, including reading analytics and publishing content
• You represent that you have the authority to connect those accounts and grant these permissions
• You may disconnect any account at any time, which immediately revokes our access
• We are not responsible for actions taken by third-party platforms (e.g., account suspensions, API changes, or content removals)
• You remain responsible for all content published through your connected accounts, including AI-generated content you approve for posting

5. AI-Generated Content

The Service uses AI models to generate content suggestions. You acknowledge that:

• AI-generated content is provided as suggestions and may require editing before publishing
• You are solely responsible for reviewing, approving, and publishing content — automated workflows still operate under your authorization
• AI-generated content may occasionally be inaccurate, inappropriate, or unsuitable for your audience
• We do not guarantee that AI-generated content will be original or free from similarity to existing content
• You own the content you create and publish through the Service, subject to the licenses granted below

6. Your Content and Data

You retain ownership of all content you create, upload, or generate through the Service. By using the Service, you grant us a limited, non-exclusive license to store, process, and display your content solely to provide and improve the Service. We do not use your content to train AI models or share it with other users.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party platform terms of service
• Publish spam, misleading content, or content that impersonates others
• Distribute malware or engage in phishing
• Attempt to gain unauthorized access to other accounts or systems
• Circumvent usage limits, rate limits, or other technical restrictions
• Use the Service in any way that could damage, disable, or impair the platform
• Resell or redistribute access to the Service without authorization (white-label features on the Agency plan are an authorized exception)

We reserve the right to suspend or terminate accounts that violate these terms.

8. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.

Third-party platform APIs (Twitter, Facebook, etc.) may change, experience downtime, or modify their terms at any time. We will make reasonable efforts to maintain integrations but cannot guarantee continuous compatibility with all platforms.

9. Limitation of Liability

To the maximum extent permitted by law, The Content Engine and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or meet your specific requirements. We do not warrant the accuracy, reliability, or quality of any AI-generated content.

11. Indemnification

You agree to indemnify and hold harmless The Content Engine and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

Either party may terminate these Terms at any time. You may terminate by cancelling your subscription and closing your account. We may terminate or suspend your access if you violate these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
